The purpose of this Retreat Agreement is to communicate our mutual expectations during Within Retreats experiences. If you have any questions before booking, reach out to us so we can ensure we are on the same page.                                                                                                                                                                  

In exchange for being allowed to participate in the Retreat, you agree to be bound to the following terms:`

1. Parties

This Agreement is made between Within Retreats (Within Retreats, we, us, and our) and you, the undersigned (electronically or by hand) or person who has clicked “I Agree” to this Agreement (guest, you and your).

2. Deposit and Payment

To reserve your spot on a retreat an $500 nonrefundable deposit is required. Full payment is due 90 days prior to the retreat.

3 Guest Cancellations & Refunds 

Full payment, less the nonrefundable deposit, is refundable if a request to withdraw from the retreat is received by Within Retreats at least 90 days prior to the retreat.  Requests to withdraw must be emailed to samantha@retreatswithin.com. If a guest withdraws less than 90 days before a retreat, no refund is available. If a guest leaves during the retreat, no refund is available. We highly recommend purchasing travel insurance at the time of your booking so you are protected in the event you need to cancel with less than 90 days' notice.

4. Within Retreats Cancellations 

Within Retreats reserves the right to cancel any trip or part of the trip. In this event we will provide retreat credit, which will be valid for two years. If Within Retreats cancels a retreat for any reason, including Force Majeure, Within Retreats is not responsible for loss of funds in association with travel arrangements made by the guest. We highly recommend purchasing travel insurance at the time of your booking, so you are protected. 

5. Passports, Visas, and Flights 

You are responsible for obtaining all required travel documents for countries you will visit during the retreat. For many countries, passports must be valid for at least 6 months beyond the duration of the trip. Visa information will vary location to location, and details will be included in your trip’s logistics. You are responsible for booking flights to the retreat. We are not responsible if you are refused entry into the country because of incorrect travel documents and this event will not result in a refund.

6. No Guarantees

Within Retreats makes no guarantees that you will get any specific results from your participation in the Retreat. We do, however, promise that we will try our best to do everything to ensure you have the most wonderful experience.

7. Ownership of Materials and Content

All the materials and content that we provide to you, including but not limited to videos, documents and PDFs, are for your use only and are not to be re-distributed or re-used. 

8. Media Release

You understand that Within Retreats may use photos, audio, video or other media captures of your face, name, voice or likeness of you to document, share and promote Within Retreats and this Retreat. By participating in the Retreat, you consent to the use of this media. You give consent to the use of this media while knowing and understanding that your name, comments, and other identifying factors may be revealed to the public. However, Within Retreats may not make known to any party in any medium a guest’s known or previously known location, email or physical address, or any other contact details, such as phone number, except as provided in paragraph 13, below.

Please communicate prior to the Retreat if you do not want us to share any media of you. 

9. Recommended Travel Insurance

We recommend you obtain “cancel anytime” travel insurance that covers your participation in the activities on the Retreat. Each client is 100% responsible for any loss, penalties, fees, or other financial consequences arising out of booking a trip or the cancellation of a trip.

10. Requests for a Roommate 

If you are traveling alone, and would like to book a shared room, we will do our best to room you with another guest. If we are unable to fill the room, you may need to upgrade to a private room. If this is the case, we will give you as much notice as possible.

11. Discretion to Deny Bookings

We reserve the right to reject any client booking at any time prior to the start date.

12. Health, Immunizations, and Travel Warnings

Each guest assumes full responsibility for researching the safety and security of countries that will be visited. Guests should visit their physician to know what vaccines are recommended. By booking a trip with Within Retreats, you confirm that you are in good health and capable of performing the activities on the trip you booked. You are also confirming that you are able to care for yourself during the trip and do not have any medical conditions that could cause risk for yourself or others during the trip.

13. Privacy Policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a trip, or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip.

14. General Indemnity

You hereby fully indemnify Within Retreats and any of its members, directors, officers, employees, contractors, volunteers, agents, executors, administrators, successors, family members and assigns (the “Indemnified Parties”) and save harmless the Indemnified Parties from any losses, claims, damages, actions, causes of action, costs and expenses that an Indemnified Party may sustain, incur or suffer at any time, either during or after the Retreat, which are based upon, arise out of or occur, directly or indirectly, by reason of any act or omission by you in participating in the Retreat, provided that where Within Retreats has contributed to such liability by its own negligent conduct, your indemnity obligation will be limited proportionately.

15. Choice of Laws, Venue, and Miscellaneous

This Agreement will be governed exclusively by the laws of the State of California. The parties agree to submit all claims to the exclusive jurisdiction of the courts of the State of California in Los Angeles County, California. 

If any provision(s) of this Agreement are invalid or unenforceable, the other provisions in the Agreement will remain in full force and effect. 

This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements. 

The waiver by Within Retreats of any breach by guest of any provision of this Agreement will not be taken to be a waiver of any further breaches by guest. 

The Parties agree that this Agreement may be signed electronically or agreed to by having you click “I Agree,” the effect of which will be the same as if both parties signed the Agreement by hand and the intention of which is that both parties desire to be bound by all the terms of the Agreement.
